The terms of booking and participation.

In short: you book by asking us, we confirm and invoice, and the cancellation terms on each event page are the ones that count. Our work is educational and experiential, not medical care. You take part as an adult who has judged it right for you. New York law applies, and if we ever disagree, we talk first.

Who these terms are between

These terms are a contract between you and Andcutmedia Inc ("we", "us"), which operates Rare Human from 180 River Dr., Apt 1425, Jersey City, NJ 07310, United States. They govern your use of rare-human.com and your booking of, and participation in, every Rare Human experience, retreat, program, online session and organization engagement. By using the site, sending us a form, booking, or taking part, you agree to them.

The participant waiver is part of these terms for anything you attend. The privacy policy explains what we do with your information. Where an event page, a retreat page or a written proposal states something different from these terms, the event page, retreat page or proposal wins for that experience.

What we offer

Live experiences, retreats and online sessions for individuals, and talks, workshops and programs for organizations. All of it is education and guided practice in applied body intelligence: breath, attention, facial self-practice, movement, scent, voice and rest.

None of it is medical care, physiotherapy, psychotherapy, nutrition advice or any other licensed professional service, and none of it replaces advice from a clinician who knows you. Nothing we say, write or practice is a diagnosis or a treatment. If you are in crisis, contact a clinician or emergency services.

We change what we offer. Each event page states the format, venue, duration, price and what is included, and that page controls where it differs from this one.

Who can take part

• You must be eighteen or over. We do not admit minors, with or without a guardian.
• Where an experience is listed "For Women", it is designed for and open to women. Experiences and programs listed "Open to All" are open to everyone. Programs for organizations are open to all genders.
• You must be able to follow facilitator guidance for the safety of the group, and be sober on arrival.

Booking and payment

Individual experiences and retreats

1. You ask for a place through the form on the event page or by email.
2. We confirm availability and send an invoice or a payment link. Prices are in US dollars. Any tax is shown on the invoice.
3. Your place is held once we receive payment. For retreats, a deposit holds your place and the balance is due on the date stated on the retreat page or in your confirmation. If the balance is not paid by that date, we may release the place and the deposit terms below apply.
4. Your confirmation email states what is included. Travel, accommodation before or after a retreat, and personal expenses are not included unless it says so.

Organizations

Engagements for organizations are described in a written proposal. Once you accept the proposal, it and these terms together form the agreement. Invoices are due within thirty days unless the proposal states otherwise. Travel outside New York City, accommodation, participant materials and shipping are quoted separately. Program dates are held once the first invoice is paid.

Cancellation and refunds

If you cancel

The cancellation terms on the event page take precedence. Unless that page says otherwise, these defaults apply to individual experiences:

• Seven or more days before the experience: full refund.
• Between seven days and 48 hours before: no refund, but you may transfer your booking to a future experience of equal or lower price, once.
• Less than 48 hours before: your place is held for you but is not refundable or transferable to another date. You may send someone else in your place if you tell us before the start.

Retreats have their own deposit and balance schedule, stated on the retreat page and in your confirmation, because we commit to venues months ahead. Deposits are non-refundable after the date stated there. We strongly recommend travel insurance that covers cancellation.

Organization engagements follow the cancellation terms in the proposal. If the proposal is silent, work delivered and non-recoverable costs already incurred are payable, and the rest is refunded.

To cancel, email hello@rare-human.com. The date we receive your email is the cancellation date.

If we cancel or change

If we cancel an experience, or move it by more than 24 hours or to a different city, you choose between a full refund of what you paid us and a transfer to another date. If we change a facilitator, a venue within the same city, or a detail of the program, the booking stands.

If weather, illness, a venue failure or another event outside our control stops us from running an experience, we reschedule it or refund what you paid us. We are not responsible for travel, accommodation or other costs you incurred to attend, which is another reason to insure a retreat trip.

Taking part

• Arrive on time. Some practices cannot be joined once they have begun.
• Every practice is optional. You may stop, sit out, step out or adapt anything at any moment without explaining why.
• What other participants share in the room stays in the room. You agree not to repeat it, and not to record any part of a session without the facilitator's and every participant's consent.
• Treat facilitators, participants and venue staff with respect. No harassment, no advice-giving to others unless asked, no substances.
• A facilitator may ask you to leave an experience if your conduct makes it unsafe or unworkable for others. No refund is due in that case.
• You are responsible for your belongings.

Your health and safety

You decide whether an experience is right for you. Read the participant waiverbefore you book; you accept it when you book and confirm it when you arrive. If you are pregnant, injured, recovering from surgery or a procedure, or living with a condition that breath, movement, scent, facial tools or emotional work could affect, speak with your clinician first and tell the facilitator before the start. We may adapt your participation, or decline it, for your safety or the group's, and will say so plainly.

Photography and recording

We sometimes photograph or film experiences. The waiversets out how, and how to opt out at check-in. You may take photographs of yourself outside sessions; you may not record sessions or other participants.

Our content and methods

The site, our name and marks, the methods, sequences, scripts and materials we teach, the practice guides we give you, and our books and writing belong to us or to those who license them to us. You may use what we give you for your own personal practice. You may not copy, publish, teach, sell or build a service on our materials or methods without our written permission. If you want to bring our work to your own community or organization, ask us; that is what our programs are for.

If you give us feedback or ideas, we may use them without owing you anything.

Using the site

• The information you send through our forms must be accurate and your own. Do not submit someone else's details without their permission.
• Do not scrape the site, probe its security, or interfere with its operation.
• Links to other sites are provided for convenience; we do not control or endorse them.
• We try to keep the site accurate and available, but it is provided as it is. A price or date shown in error may be corrected before we confirm your booking.

Limits of our responsibility

To the fullest extent the law allows:

• We are not responsible for indirect or consequential loss, including lost income, travel or accommodation costs, or any outcome you hoped for from an experience.
• Our total responsibility to you for anything arising from an experience or from these terms is limited to the amount you paid us for that experience, or one hundred US dollars if you paid nothing.
• You agree to cover us for claims that arise from your breach of these terms or the waiver, or from your own misconduct.

Nothing in these terms limits responsibility that the law does not allow us to limit, including for death or personal injury caused by our own gross negligence or willful misconduct, or for fraud. Some laws do not permit some of the limits above; where that is the case, they apply only as far as the law permits. If you are a consumer, you keep any rights that the law of your home jurisdiction gives you and does not allow you to give up.

Governing law and disagreements

These terms are governed by the law of the State of New Jersey, without regard to its conflict-of-law rules. If something goes wrong, write to us first at hello@rare-human.com. We will talk in good faith for at least thirty days before either of us starts a formal process. After that, any claim is brought in the state and federal courts located in Hudson County, New Jersey, and you and we both accept those courts. If a mandatory law where you live gives you the right to bring a claim in your own courts, this does not take it away.

Changes to these terms

We may update these terms; the date at the top shows when. The version in force when you book governs that booking. Continuing to use the site after a change means you accept the change for the future.

Everything else

• These terms, the participant waiver, the relevant event or retreat page, and, for organizations, the accepted proposal, are the whole agreement between us for an experience.
• If a court finds part of these terms unenforceable, the rest stands.
• If we do not enforce a term once, we may still enforce it later.
• You may not transfer your booking or these terms to someone else except as these terms allow. We may transfer them to a successor of the business, and this does not reduce your rights.
